Age exemption for eligible medical practitioners in regional Australia


To attract and retain vital health services in rural areas, there is an exemption to the age requirement for eligible medical practitioners who are 50 years of age and over, work in regional Australia and who wish to apply for the Subclass 186 Visa and Subclass 187 Visa.

 

From 1 July 2015, the age exemption available to medical practitioners in regional Australia will no longer require employment with the same employer while holding a Temporary Work (Skilled) Subclass 457 Visa or a Medical Practitioner (Temporary) Subclass 422 Visa.

 

Instead, medical practitioners applying for a Subclass 186 or Subclass 187 Visa must demonstrate at least four years employment in the nominated occupation. These medical practitioners must demonstrate that at least two years of the required four years employment was located in regional Australia and the nominated position will also be located in regional Australia.

Changes to Consolidated Skilled Occupation List (CSOL) - NEW occupations 'Hydrogeologist' & 'Exercise Physiologist'


From 1 July 2014, the following occupations will be added to the CSOL:

Hydrogeologist  (ANZSCO 234413)
Exercise Physiologist (ANZSCO 234915)

The following titles of occupations will be changed:

Ship's Surveyor will be titled Marine Surveyor (ANZSCO 231215)
General Medical Practitioner will be titled General Practitioner (ANZSCO 253111)

Is There a Pathway to Permanent Residence Under the Employer Nomination Scheme for Persons Over the Age of 50?


In most cases, the answer to this is “No”, however there are a number of exceptions which it is important to be aware of.

Under the migration regulations there are a number of classes of person who are exempt from the age criteria. These are as follows:

- Ministers of religion who have applied for a visa to occupy a position as nominated by a religious institution, or,

- certain researchers, scientists and technical specialists who have applied for a visa to occupy a position nominated by an Australian scientific government agency; or,

- certain senior academics who have applied for a visa to occupy a position nominated by a university in Australia,

- persons who have been working for the nominating employer as the holder of a subclass 457 visa for at least the 4 years immediately before applying and whose annual earnings for each year in the four-year period was at least equivalent to the Fair Work High Income Threshold (currently $129,300), or,

- certain medical practitioners.

Anyone over the age of 50 who believes their circumstances may match any of those outlined above should seek legal advice in relation to their permanent prospects.
